LIABILITY WAIVER

This Liability Waiver Agreement (the “Agreement”) is entered into as of the date written below by and between MY HEALTH MATTERS FITNESS AND WELLNESS LLC, a Massachusetts limited liability company (the “Company”) and the undersigned (the “Client”).

WHEREAS, the Client has retained the services of the Company to provide certain personal fitness training as well as health and wellness services to the Client (collectively the “Services”).

For good and valuable consideration the receipt and sufficiency of which are hereby acknowledged the Client and the Company hereby agree:

1. The Client assumes all risks associated with the Company’s delivery of the Services to the Client and agrees to save and hold harmless and indemnify the Company and its officers, members, employees, agents, independent contractors, successors and assigns from and against all liabilities, claims and damages on account of personal injury of any kind whatsoever which arise out of or are in any manner connected with, or are claimed to arise out of or be in any manner connected with, the provision of Services by the Company to the Client including but not limited to any liabilities, claims or damages arising out of or in connection with the Client being diagnosed with COVID-19 and any subsequent complications from the disease.
